Terms of Service

Welcome to FlowFoundry. These Terms of Service ("Terms") govern your access to and use of the FlowFoundry website, services, and software applications published on the Freshworks Marketplace (each, an "App"). By visiting our site or installing our Apps, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By creating an account, registering for, downloading, installing, or using any FlowFoundry App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Marketplace License & Limitations

Subject to your compliance with these Terms and payment of any applicable marketplace licensing fees, FlowFoundry grants you a non-transferable, non-sublicensable, non-exclusive, revocable, limited license to download, install, and use the Apps solely within your authorized Freshworks tenant instance.

  • Reverse Engineering: You agree not to copy, modify, distribute, sell, lease, translate, adapt, decompile, disassemble, or reverse engineer the Apps or their underlying codebases.
  • Unauthorized Access: You may not bypass or attempt to bypass any licensing controls, security mechanisms, or rate-limiting filters implemented within the Apps.

3. Fees, Subscription, and Billing

Subscription management, billing, and invoicing are handled securely through the Freshworks Marketplace billing system.

  • Licensing Model: Apps are offered on a flat monthly or annual subscription fee as detailed in the app listing catalog.
  • Cancellation: You may cancel your subscription at any time directly via your Freshworks Marketplace admin portal. Following cancellation, access to premium app functionalities will terminate at the end of the current billing cycle.
  • Refunds: Refund policies are governed by the Freshworks Marketplace terms. FlowFoundry does not issue direct refunds for marketplace transactions.

4. Acceptable Use Policy

You agree to use our site and Apps solely for lawful purposes. You must not use our software to process, import, or upload any files or data that:

  • Contain software viruses, worms, malware, or other malicious computer code designed to disrupt support operations.
  • Infringe upon the intellectual property rights, privacy rights, or publicity rights of third parties.
  • Violate any applicable local, state, national, or international data protection laws (e.g., GDPR, CCPA).

5. Security of Credentials & Configuration

You are solely responsible for securing your Freshworks API keys, account tokens, and third-party API credentials configured within the App settings. FlowFoundry is not responsible for unauthorized system access resulting from credentials leakage, security gaps on your local systems, or Freshworks platform vulnerabilities.

6. Disclaimers & Limitation of Liability

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWFOUNDRY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FlowFoundry does not guarantee that the Apps will operate uninterrupted, secure, or completely error-free. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, customer service interruption, or operational disruptions arising from your use of or inability to use the Apps.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu.

8. Changes to Terms

FlowFoundry reserves the right to modify these Terms at any time. We will indicate revisions by updating the "Last Updated" date at the top of this document. Your continued use of the Apps or website after such changes constitutes acceptance of the new Terms.
